This book probes the texts of Paul Ricoeur and Edith Stein to disclose the role of silence in the creation of meaning. To understand and live out of contemplative awareness as a way to think through transformative human experience is an ethical and spiritual task, one that warrants explanation and interpretation.

Rather (...) than a general study of Roman slaves’ material culture, the reader will find here an anthropology of the architecture of the spaces and built environments in which slaves dwelt and toiled (5). Thus, the focus is not so much on the material conditions in which slaves lived or the artifacts they worked with, but on the layout of a small set of first century c.e. houses, streets and economic units, mostly found in the Bay of Naples, Ostia, and the ager Cosanus. The study of space serves Joshel and Hackworth Petersen as an attempt to reconstruct slaves’ responses, through adaptation and challenge, to the choreography of movements imposed on them by their masters.Methodologically, this investigation operates on the distinction developed by Michel De Certeau (The Practice of Everyday Life [1988]) between the strategies of the powerful to delimit a space in which power relations can be managed to their own advantage and the tactics of the weak to seize the opportunities to use an imposed spatial order for their own ends (8). The authors see their work as “an act of remembrance” (222). Their aim is to make invisible slaves visible again. Slaves, they contend, have not only been silenced in classical texts written by and from the point of view of slave owners. In the process of collecting and analyzing ancient material, and in the crafting of their historic narratives, modern archaeologists, art historians, and even tourism authorities have “actively, if unwittingly made [slaves] disappear” (3). To redress the imbalance, Joshel and Hackworth Petersen walk away from mere static descriptions of archaeological sites and concentrate on the dynamic of slaves’ movements within those spaces.Although the authors rely on other archaeologists and historians’ fieldwork and interpretation of the material remains, they themselves visited most of the sites and buildings they describe. The book is profusely illustrated with sixteen plates and 170 figures, among which we find the authors’ own photographs of some of the structures they discuss, such as doorways, storage rooms, stairs, porticos, kitchens, street benches, and fountains. Other illustrations consist of maps of Pompeii, Herculaneum, and Ostia (19–21), street plans of Pompeii (plates VI, VII, and XI), and building plans of the houses, workshops and villae dealt with in the body of the text. Constant cross-reference to these images and drawings helps the reader to see and understand space in three dimensions, something [End Page 709] that it is not always easy to elicit from illustrations and archaeological reports in which findings are presented in a two-dimensional plane.The book is divided into six chapters. The Introduction (chap. 1) lays out the aims of the book and the methodological approach chosen by the authors. In the next four chapters, the discussion of built environments moves from the inside to the outside and from an urban set-up to the rural world. Chapter 2 focuses on the architectural layout of houses from Campania and Rome’s port-town, Ostia: namely, the houses of the Menander, Julius Polybius, Sutoria Primigenia, the Smith, Lucretius Fronto, the Ceii, the Vetii, and the Gilded Cupids in Pompeii; the houses of the Corinthian Atrium, the Mosaic Atrium, the Alcove, the Beautiful Courtyard, the Samnite, and the Grand Portal in Herculaneum; and the Ostian house of the Muses.The analysis of the Roman domestic landscape uses Andrew Wallace-Hadrill’s two axes of differentiation between the grand and the humble and the public and the private (Houses and Societies in Pompeii and Herculaneum [1994]:38), but the emphasis is on the slaves’ perspective within this framework, rather than the owners’—even though the latter is not absent. In 2003, the South Carolina Supreme Court upheld the conviction of Regina McKnight, an African American woman who was convicted at the age of twenty‐two for committing “homicide by child abuse.” She became the first woman in the United States to be arrested, prosecuted, and convicted for experiencing a stillbirth. Rather than an outlier case in the annals of American jurisprudence that stretched law beyond reason while restraining compassion and justice, McKnight's conviction inspired similar prosecutions of other poor black women (...) and then of other women. More than one‐third of states consider pregnant women's illicit drug use a form of child abuse, resulting in unprecedented forms of criminal and civil punishment. Laws previously understood to protect pregnant women from domestic violence during pregnancy, such as fetal protection laws, now serve as the vehicles for prosecuting pregnant women. What these prosecutions and laws expose are the multitudinous ways in which the criminalization of poor pregnant women—and normalization of that criminalization, such that even doctors and nurses are expected to participate in it—serve to humiliate women, interfere with their reproductive health, and ultimately rob women of reproductive autonomy. Marginal structural models can be used to estimate the causal effect of a potentially time-varying treatment in the presence of time-dependent confounding via weighted regression. The standard approach of using inverse probability of treatment weighting can be sensitive to model misspecification and lead to high-variance estimates due to extreme weights. Various methods have been proposed to partially address this, including covariate balancing propensity score to mitigate treatment model misspecification, and truncation and stabilized-IPTW to temper extreme weights. In this article, we (...) present kernel optimal weighting, a convex-optimization-based approach that finds weights for fitting the MSMs that flexibly balance time-dependent confounders while simultaneously penalizing extreme weights, directly addressing the above limitations. We further extend KOW to control for informative censoring. We evaluate the performance of KOW in a simulation study, comparing it with IPTW, sIPTW, and CBPS. We demonstrate the use of KOW in studying the effect of treatment initiation on time-to-death among people living with human immunodeficiency virus and the effect of negative advertising on elections in the United States. This paper supports the personal data platform cooperative as a means of bringing about John Rawls’s favoured institutional realisation of a just society, the property-owning democracy. It describes personal data platform cooperatives and applies Rawls’s political philosophy to analyse the institutional forms of a just society in relation to the economic power deriving from aggregating personal data. It argues that a society involving a significant number of personal data platform cooperatives will be more suitable to realising Rawls’s principle of fair (...) equality of opportunity. (shrink)

Summary By introducing the concept of “invariants”, Koffka endowed perceptual psychology with a flexible theoretical tool, which is suitable for representing vision situations in which a definite part of the stimulus pattern is relevant but not sufficient to determine a corresponding part of the perceived scene. He characterised his “invariance principle” as a principle conclusively breaking free from the “old constancy hypothesis”, which rigidly surmised point-to-point relations between stimulus and perceptual properties. In this paper, we explain the basic terms and (...) assumptions implicit in Koffka’s concept, by representing them in a set-theoretic framework. Then, we highlight various aspects and implications of the concept in terms of answers to six separate questions: forms of invariants, heuristic paths to them, what is invariant in an invariant, roots of conditional indeterminacy, variability vs. indeterminacy, and overcoming of the indeterminacy. Lastly, we illustrate the lasting value and theoretical power of the concept, by showing that Koffka’s insights relating to it do occur in modern perceptual psychology and by highlighting its role in a model of perceptual transparency. BackgroundCommentators believe that the ethical decision-making climate is instrumental in enhancing interprofessional collaboration in intensive care units. Our aim was twofold: to determine the perception of the ethical climate, levels of moral distress, and intention to leave one's job among nurses and physicians, and between the different ICU types and determine the association between the ethical climate, moral distress, and intention to leave.MethodsWe performed a cross-sectional questionnaire study between May 2021 and August 2021 involving 206 nurses and physicians in a (...) large urban academic hospital. We used the validated Ethical Decision-Making Climate Questionnaire and the Measure of Moral Distress for Healthcare Professionals tools and asked respondents their intention to leave their jobs. We also made comparisons between the different ICU types. We used Pearson's correlation coefficient to identify statistically significant associations between the Ethical Climate, Moral Distress, and Intention to Leave.ResultsNurses perceived the ethical climate for decision-making as less favorable than physicians. They also had significantly greater levels of moral distress and higher intention to leave their job rates than physicians. Regarding the ICU types, the Neonatal/pediatric unit had a significantly higher overall ethical climate score than the Medical and Surgical units and also demonstrated lower moral distress scores and lower “intention to leave” scores compared with both the Medical and Surgical units. The ethical climate and moral distress scores were negatively correlated ; moral distress and "intention to leave" was positively correlated ; and ethical climate and “intention to leave” were negatively correlated.ConclusionsSignificant differences exist in the perception of the ethical climate, levels of moral distress, and intention to leave between nurses and physicians and between the different ICU types. Inspecting the individual factors of the ethical climate and moral distress tools can help hospital leadership target organizational factors that improve interprofessional collaboration, lessening moral distress, decreasing turnover, and improved patient care. In this paper we discuss an often-neglected topic in the literature on the ethics of voting. Our aim is to provide an account of what states are obligated to do, so that voters may fulfil their role as public decision-makers in an epistemically competent manner. We argue that the state ought to provide voters with what we call a substantive opportunity for competence. This entails that the state ought to actively foster the epistemic capabilities that are necessary to achieve competent (...) participation in political decision-making practices. (shrink)

Allocating attention determines what we remember later. Attentional demands vary in a task-switching paradigm, with greater demands for switch than for repeat trials. This also results in lower subsequent memory performance for switch compared to repeat trials. The main goal of the present study was to investigate the consequences of task switching after a long study-test interval and to examine the contributions of the two memory components, recollection and familiarity. In the study phase, the participants performed a task-switching procedure in (...) which they had to switch between two classifications tasks with pictures. After a short vs. a long study-test interval of a week, the participants performed a surprise memory test for the pictures and gave remember/know judgements. The results showed that recognition memory declined after 1 week and this was mainly due to a decrease in “remember” responses. The results also showed that the task-switching effect on memory was enduring. Whereas the results of the immediate test were mixed, the results of the delayed tests showed that the task-switching effect was based on recollection, expressed in more “remember” responses for repeat than for switch trials. As recollection is more sensitive to attention manipulations than familiarity, the results align with the notion that attentional requirements at study determine what we remember, in particular after a long study-test interval. This article argues that beneath the veneer of legitimacy in the organ, tissue, and body part transplantation systems exists a horrifying history of human commodification whose vestiges surprisingly linger in contemporary supply and allocation systems. This history, as the Article demonstrates, dates back to the colonial period in the United States, where “grave robbing” became an important feature in the advancement of medicine. This legacy lives on.

For nearly five years, bioethicists and neurologists debated whether Jahi McMath, an African American teenager, was alive or dead. While Jahi's condition provides a compelling study for analyzing brain death, circumscribing her life status to a question of brain death fails to acknowledge and respond to a chronic, if uncomfortable, bioethics problem in American health care—namely, racial bias and unequal treatment, both real and perceived. Bioethicists should examine the underlying, arguably broader social implications of what Jahi's medical treatment and experience (...) represented. On any given day, disparities in the quality of health care and health outcomes for people of color in comparison to whites are evidenced in American hospitals and clinics. These disparities are not entirely explained by differences in patient education, insurance status, employment, income, expressed preference for treatments, and severity of disease. Instead, research indicates that, even for African Americans able to gain access to health care services and navigate institutional nuances, disparities persist across a broad range of services, including diagnostic screening and general medical care, mental health diagnosis and treatment, pain management, HIV‐related care, and treatments for cancer, heart disease, diabetes, and kidney disease. The Body–Object Interaction (BOI) variable measures how easily a human body can physically interact with a word's referent (Siakaluk, Pexman, Aguilera, Owen, & Sears, ). A facilitory BOI effect has been observed with adults in language tasks, with faster and more accurate responses for high BOI words (e.g., mask) than for low BOI words (e.g., ship; Wellsby, Siakaluk, Owen, & Pexman, ). We examined the development of this effect in children. Fifty children (aged 6–9 years) and a group of 21 (...) adults completed a word naming task with high and low BOI words. Younger children (aged 6–7 years) did not show a BOI effect, but older children (aged 8–9 years) showed a significant facilitory BOI effect, as did adults. Magnitude of children's BOI effect was related to age as well as reading skills. These results suggest that bodily experience (as measured by the BOI variable) begins to influence visual word recognition behavior by about 8 years of age. (shrink)

The study of legal transplants provides a vital critical supplement to mainstream theories about legal change. Legal transplants are not exceptional or isolated occurrences, despite the economic, social, political and cultural barriers that separate the world’s legal systems. This Article goes beyond traditional approaches to the study of transplants by substituting the figurative language of transplants with explicit theory about how legal change is produced. It first provides a brief account of what the literature on legal transplants has achieved so (...) far in terms of "macro" explanations of legal change currently available. It then argues that legal transplants as social acts performed by individuals call for a study of the "micro" level of engagement with legal change by individuals. The key notion that is advanced to explore this dimension is the notion of mediated action, which denotes action that is performed by individuals making use of features of the environment as tools to interact in a specific setting. The notion of mediated action was first introduced in cultural-historical psychological investigations of the social formation of the mind. As social acts, legal transplants represent instances of mediated action. The last part of this Article highlights how legal transplants raise questions of justice and discusses briefly how the new approach to the study of transplants advocated here relates to them. Luciano Floridi was not the first to discuss the idea of group privacy, but he was perhaps the first to discuss it in relation to the insights derived from big data analytics. He has argued that it is important to investigate the possibility that groups have rights to privacy that are not reducible to the privacy of individuals forming such groups. In this paper, we introduce a distinction between two concepts of group privacy. The first, the “what happens in Vegas (...) stays in Vegas” privacy (in the following: WHVSV privacy), deals with confidential information shared with the member of a group and inaccessible to (all or a specific group of) outsiders. The second, to which we shall refer as inferential privacy, deals with the inferences that can be made about a group of people defined by a feature, or combination thereof, shared by all individuals in the group. We show why we unreservedly agree with Floridi that groups can have a form of privacy that amounts to more than the mere fact of being sets of individuals each of whom has individual privacy; moreover, like Floridi, we find it plausible that at least some groups (those satisfying our definition of type-a groups) may have a right to a species of group privacy (that is, WHVSV privacy) as groups (and not just as individuals who belong to those groups). However, by turning our attention to the context of big data analytics, we show that the relevant, new notion of group privacy is one of inferential privacy. We argue that an absolute right (either of individuals or groups) to inferential privacy is implausible. We also show that many groups generated algorithmically (those satisfying our definition of type-b groups) cannot be right holders as groups (unless they become type-a groups). (shrink)

It will show how the external influences the Stoic mind in several crucial ways: 1) Constitutive Role: The external world acts as a constitutive factor for the soul (the third level of the scala naturae), shaping its development. At the fourth level, the logos (rational principle) interacts with qualified external objects. These objects form the basis of abstract reasoning and teachings derived from external sources; 2) (...) Truth-Making Function: The external world serves as a truth-maker for phantasiai and the axiomata associated with them, providing validation and substance to internal representations and core beliefs; 3) Opposition to External Goods: For the Stoic soul dedicated to virtue, external goods are elements to be opposed or transcended. The Stoic perspective emphasizes the pursuit of virtue as independent of external goods, which are considered indifferent or secondary to moral development; 4) Condition of Possibility: the external void or incorporeal space is a necessary condition for the growth of the cosmos, including its periodic conflagration (destruction) and subsequent reconstitution. This article presents the results of the longitudinal study of Addiopizzo, a successful anti-bribery organization founded in Sicily in 2004. It analyzes how this organization has used information disclosure as a strategy to fight adverse environmental conditions and the immoral activities of the Sicilian Mafia. This article extends the business ethics and corporate social responsibility literature by showing how multi-level strategic information disclosure processes can help gain organizational legitimacy in adverse social environments and successfully fight against social resistance to change, (...) low levels of moral imagination and attacks from criminal organizations. This article provides an additional contribution to the literature by linking the three research streams on corporate transparency, the fight against corruption, and organizational legitimacy. The results of this research also contribute to the special issue of the EBEN AC 2010, “Which values for which organizations”, since it provides a unique example of an organization capable of spreading the values of social justice and honesty in a difficult social environment plagued by Mafia. Les dictionnaires d’associations évoquées par les mots sont créés à partir de la collecte des réactions données à un stimulus lexical. La plupart de ces réactions s’explique par des relations logiques basées sur le sens du stimulus proposé. Cependant une certaine quantité de ces réactions est provoquée par la forme de ce lexème, et procède du désir du participant à l’expérience de jouer avec les mots. Nous analyserons ici cette catégorie de réactions pour en proposer une typologie : le jeu (...) peut consister en un simple écho du stimulus, soit c’est l’association des deux qui est ludique. Nous analysons les cas douteux, qui peuvent être dus à une lecture erronée du stimulus ou une orthographe douteuse de la réaction, et discuterons du bien-fondé de la prise en compte des jeux de mots dans le dictionnaire d’associations, dont le principe est d’être formé de réactions spontanées au stimulus, tandis qu’un jeu de mot suppose une réflexion, si courte soit-elle. To find out, the author guides us in a philosophical dialogue between different scientific disciplines, from psychology to biology, passing through neuroscience, through countless curiosities and curious anecdotes, from racist plants to pig trials. The result is a popular essay that intrigues, but also a concrete example of how philosophical practice can really improve everyday life.

Los mecanismos a través de los cuales operan y las presuposiciones de cada uno de ellos son cuidadosamente analizados.
